Novartis Employee Blows Whistle on Tasigna Fraud and Others

The FDA forces Novartis to pay $500 million in fines for Medicaid and Medicare fraud for misrepresenting five of its patented drugs including Tasigna

Friday, July 20, 2018 - David Kester, a former manager for Swiss pharmaceutical giant Novartis AG recently "blew the whistle" on the company, calling them out for their illegal, unethical and fraudulent marketing practices, misrepresenting five of its patented drugs including Tasigna. Tasigna is an anti-cancer chemotherapy medication that was brought to market using the FDA 501 (k) fast-track program, to replace the company's other cancer drug that was to go off patent. Rather than risk their monopoly on the billion-dollar per year cancer drug market to much less expensive generic drugs, specialty pharmacists were bribed with various schemes to secretly refill Gleevec prescriptions with Tasigna. All the while, not a word was mentioned to unsuspecting and vulnerable cancer patients that Tasigna carried much greater and potentially deadly side effects.

Kester Named Whistleblower of the Year

For his courage in exposing the multi-billion dollar marketing fraud, one serious enough to put the lives of thousands of innocent cancer patients at risk, David Kester was named the "Whistleblower of the Year" in 2016. Lawsuits filed by Kester on behalf of the US Department of Justice against Novartis and specialty pharmacies BioScsript and Accredo yielded taxpayers close to one half a billion dollars in fines. Specialty pharmacists handle drugs that are considered more toxic and potentially lethal to patients and are held to a high level of ethical standards. BioScsript and Accredo were paid bribes to recommend five of Novartis' patented drugs including Tasigna and to ignore Tasigna's side effects. Tasigna has been proven to cause atherosclerosis, a thickening, and narrowing of the arteries. Tasigna patients have suffered from necrosis of the toes and feet requiring amputation, paralysis from strokes and sudden death from heart attacks.

The US False Claims Act encourages employees with insider information on drugs and medical devices that could do harm to the general public to come forward. Armed with information regarding Novartis' misrepresenting five of its patented drugs including Tasigna, as well as Tasigna's potentially deadly side effects, Kester sued Novartis resulting in an 18-month investigation working in conjunction with US government attorneys. The US Medicaid and Medicare programs and taxpayers were reimbursed close to $400 million. Kester filed his complaint under the US False Claims Act that permits non-government employees to file actions on behalf of the government.

As a result of Kester's life-saving efforts as well as the high number of Tasigna atherosclerosis reports, Novartis PHarmaceutical Canada were forced to warn consumers of Tasigna. "Cases of atherosclerosis-related conditions have been reported during clinical trials and post-marketing experience with the use of TASIGNA. Patients should be screened for existing heart problems prior to receiving the medication."

If you are a Tasigna patient, suffering from atherosclerosis or if you have had a loved one die from a heart attack or stroke you should talk with a Tasigna atherosclerosis lawyer to determine whether or not you qualify for real monetary compensation and reimbursement of your medical expenses, lost wages, and pain and suffering. Tasigna's dangerous side effects include all those associated with chemotherapy such as nausea, vomiting headaches, hair and weight loss.
