Tasigna Lawsuits Against Drug Makers Novartis

Friday, June 16, 2017 - There is no doubt that Novartis, makers of the leukemia drug Tasigna, has made and continues to make huge windfall profits from sales of the drug in recent years. Quarterly profits are in the billions of dollars and much of the drugmaker's success has come from sales of Tasigna in spite of the fact that the drug has been linked to atherosclerosis in patients taking the drug for cancer treatment. Japan Stops Sales of Tasigna

The Japan Times recently reported that Novartis Japan failed to report to the Japanese government, at least 10 cases of findings of adverse side effects of their anti-cancer drug, Tasigna. The Health, Labor and Welfare Ministry has opened an investigation into whether the Novartis unit broke the law. The company conducted a required questionnaire of doctors that were prescribing the drug to some 3000 patients and 30 Tasigna patients reported serious side effects occurring after taking the drug. If more than 10 instances of adverse side effects are found, the drug maker is required by Japanese law to report these findings to the Japanese government. Novartis sales representative were made aware of the findings but continued to sell the drug anyway. In a first of its kind decision, in February 2015, Novartis was ordered by the Japanese government to suspend their sales of the drugs nationwide as a penalty for failing to notify the government of the side effects of the product.

United States Lawsuit

Recently, Novartis agreed to settle a lawsuit brought by the S. Department of Justice for $390 million. In the lawsuit, the U.S. government claimed that in an attempt to boost sales, the company paid kickbacks in the form of rebates to pharmacies that would recommend the anti-cancer drug over its competitors. The US government sought and had one the case for over $3 billion but settled for $390 million dollars and the company was not permitted to deny their guilt. Even though the company had set aside $400 million to cover the cost of the lawsuit, profits fell 2 percent on the decrease in sales of the drug as a result of the adverse publicity of the court findings.

Canadian Tasigna Warnings

Back in December of 2013, a health warning letter was sent to all physicians by Health Canada to warn them of the side effects of Novartis' cancer treatment drug Tasigna stating that the drug may increase the risk of atherosclerosis and that doctors prescribing the drug should diligently monitor their patients for signs of atherosclerosis and related diseases. The health warnings never made it to the United States and Novartis continued to operate there unabated.
